New York State Child Support Laws

Child support laws in New York have established a formula to determine precisely how much the non-custodial parent must pay each month. This formula is based on the respective gross incomes of each parent and the number of children to be supported:

  • 1 child = 17% of your income
  • 2 children = 25% of your income
  • 3 children = 29% of your income
  • 4 children = 31% of your income
  • 5 or more children = 35% of your income

Child support is always paid to the custodial parent even if this person makes more money than the non-custodial parent. The court can deviate from these percentages where justice requires and will also take a split parenting schedule into consideration when ruling on child support disputes.

In New York, child support payments are made until the children reach the age of 21 unless they become emancipated at an earlier age by events such as:

  • Marriage
  • Induction into military service
  • Leaving school in favor of full time employment
